What is an Aged Dependent Relative Visa 838?

An aged-dependent relative visa (subclass 838) is a temporary residence visa for elderly people in the process of being reunited with their family in Australia. This type of visa allows an individual over 65 years old and dependent on their family or friend to live in Australia with a sponsoring relative or friend. The sponsor must be an Australian citizen, Australian permanent resident, or eligible citizen and have been living in Australia for at least two years before applying for the Aged Dependent Relative Visa Subclass 838.

Who qualifies for an Aged Dependent Relative Visa 838?

Your relative must be an Australian citizen, permanent resident, or eligible citizen of full age and not subject to any limitation as to time permitted in Australia. In addition, you must provide evidence that the person you are sponsoring for the aged dependent relative visa will not become charged on public funds. This is similar to Aged Dependent Relative Visa Subclass 114.

The sponsor must have sufficient financial resources for the applicant's accommodation without recourse to public funds from the date of application until their visa is granted.

 Eligibility Requirements for visa 838

  • To be eligible for an Aged Dependent Relative Visa Subclass 838, you must be an Australian citizen or permanent resident and have a parent, grandparent, or sibling who is 65 years of age or older.
  • You must also be able to provide proof of your relationship with the person they are sponsored for.
  • The sponsor will need to undergo a health assessment, as well as undergo criminal record checks.
  • Once all eligibility requirements are met, you can apply for the visa from within Australia.
  • For this process to start, an application fee must be paid.
  • If approved, you'll go through the usual steps of applying for a visitor visa before coming to Australia.
  • For an application for this visa to be approved, the applicant must prove that they are sufficiently well-off financially and do not require any financial assistance from the Australian government.
  • They also need to provide evidence of their close relationship with their relative in Australia.

Documents Requirements to apply for visa 838

You will need to provide the following documents for a complete application package.

  1.  Application form.
  2. One passport-size photo of the applicant, taken within the last six months.
  3. Proof of relationship with the sponsor, e.g., marriage or birth certificate.
  4. Proof of the sponsor's Australian citizenship, e.g., Australian passport or Certificate of Citizenship.
  5. Evidence that the sponsor can support you and any dependents in Australia at a basic standard of living.
  6. Your most recent bank statement showing your account balance on the date of application and evidence that you have access to this money.
  7. Your occupation and position.
  8. A letter from your current employer stating the details of your employment contract or other evidence that you are employed.
  9. Copy of proof of any income earned by dependent children over 18 years old.
