• What to look for in a property contract before you sign

Purchasing or Selling property contract, property lawyers can be an overwhelming experience, particularly if it is your first residential transaction. Even more daunting is being handed a contract from an agent and being asked to sign on the dotted line when a purchaser or seller has little or no experience in what to look for in a contract.

Is my full name correct in the Contract?
Carefully check that your FULL NAME, including any middle names, is written correctly on the contract. If your mortgage documents include your middle name, but the property contract does not, your bank will request that the contract is amended. This can cause possible delays in obtaining finance or even settlement. In order to make any changes to a contract, authorization needs to be sought from the other party. This can take time.

  • What Should Buyers Look Out For In a Property Contract?

Buying property is such a big purchase and commitment (one of the biggest most of us are likely to ever make) that the contract is not something you want to take lightly. It’s wise to go through it with a “fine-tooth comb” and equally as wise to discuss the finer details with both your agent and a legal representative who deals in property law and conveyancing.

Not only is it important to understand what the various clauses mean, but it’s also very important to understand what’s included in the contract and if there’s anything missing that should form a part of the contract.

  • Buying Off the Plan? What you need to know about the “Sunset Clause”

A common approach to buying property is to enter into an Off the Plan Contract for the purchase of a unit or house that has not yet been built. An Off the Plan Property Contract allows you to lock in a purchase price based on the current property market and settle the contract once the development is complete. In some circumstances, it may take years before the development process is complete and settlement can occur.

However, you have the benefit of a purchase price negotiated years earlier in a potentially lower property market. In order to ensure an Off the Plan Contract does not continue for an indefinite period with no development occurring, a standard “Sunset Clause” may be included in the Contract.
